We generally do not sell information as the term “sell” is traditionally understood. However, we do share data with third parties for marketing and advertising purposes, which may be interpreted as a “sale” or “sharing” under certain laws. In the past 12-months, we have shared the following categories of information to third parties for marketing and advertising purposes: (1) persistent identifiers, such as unique device identifiers, email addresses, account information, IP addresses, information related to your browser and operating system, or any information that you provided through the Site; and (2) user activity data, such data generated through your activities on the Site.

Do Not Sell or Share My Personal Information

Under certain privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), and similar state privacy laws, you have the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising.

As described in the Sharing Your Information section above, we share data (including persistent identifiers, email addresses, IP addresses, and user activity data) with advertising networks and marketing partners in a manner that may constitute a "sale" or "sharing" under applicable law, even where no money changes hands.

To opt out of the sale or sharing of your personal information, you may:

  • Submit a request by email. Send an email to [email protected] with the subject line "Do Not Sell or Share My Personal Information." Include your full name and the email address associated with your account so we can locate and process your request.
  • Use a browser opt-out signal. We honor the Global Privacy Control (GPC) browser signal where technically feasible. If your browser is configured to send a GPC signal, we will treat it as a valid opt-out request for the device and browser sending the signal.
  • Opt out of third-party advertising directly. You may also opt out of interest-based advertising from participating networks via the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.

We will process your opt-out request within 15 business days. Please note that opting out does not remove advertising from your experience — it means that advertising you see will be less tailored to your interests. Opting out will not affect your ability to make purchases or use any feature of the Site. We will not discriminate against you for exercising this right.

If you later wish to opt back in to the sale or sharing of your personal information, you may contact us at [email protected] with the subject line "Opt Back In — Data Sharing."

Marketing & Data Usage Opt-In Controls

We respect your right to control how your personal information is used for marketing purposes. We will not enroll you in marketing programs or share your data for advertising purposes without a clear, affirmative opt-in where required by applicable law.

Email Marketing. We will only send you promotional email communications if you have expressly opted in to receive them — for example, by checking a consent box at checkout, signing up via a form on our Site, or otherwise affirmatively agreeing to receive marketing emails. You may opt out at any time by clicking the "Unsubscribe" link included at the bottom of every marketing email we send, or by emailing us at [email protected] with the subject line "Email Unsubscribe."

SMS / Text Message Marketing. We will only send you promotional text messages if you have provided your explicit written consent to receive them. Your consent to receive SMS marketing is never a condition of purchasing a product or service from us. To stop receiving promotional text messages at any time, reply STOP to any marketing text from us. Standard message and data rates from your mobile carrier may apply.

Targeted / Interest-Based Advertising. We share data with advertising networks to show you personalized ads based on your activity on our Site and elsewhere online. This sharing only occurs to the extent you have not exercised your right to opt out as described in the Do Not Sell or Share My Personal Information section above. You may opt out of this data sharing at any time using the methods described in that section.

Data Shared with Marketing Partners. We share certain personal information (such as email addresses and device identifiers) with marketing partners so they can help us reach you with relevant offers. This sharing occurs only for the purposes described in this Privacy Policy. We do not sell your name, phone number, or payment information to third-party marketers.

Withdrawing Consent. You may withdraw any previously granted consent for marketing communications or data sharing at any time by contacting us at [email protected]. Withdrawal of consent will not affect the lawfulness of any processing that took place prior to withdrawal.

Cookies, Web Beacons, and Tracking Technologies

The Site uses cookies, web beacons, and other tracking technologies to collect, use, and share your information with third parties as described in this Privacy Policy. These technologies are useful for storing your preferences and settings, enabling you to sign-in, gathering information such as browser type and operating system, providing interest-based advertising, combating fraud, analyzing how our Site or services perform, and fulfilling other legitimate purposes.

Cookies used on this Site may include: (1) required cookies used to perform essential Site functions, such as storing your preferences and settings; (2) social media cookies to show you ads and content based on your social media profiles and activities on other Sites; (3) analytics cookies to better understand how you use the Site and to improve our Site and services; (4) advertising cookies to show you ads that are relevant to you. If you previously provided information to us, a unique identifier in the cookie may associate the information collected via the cookie with your information. We may share aggregate cookie and tracking information that does not directly identify you with third parties.

Some content on the Site may be provided by third parties that use cookies in conjunction with other tracking technologies to collect information about you when you use the Site, which enables them to provide targeted advertising to you. We may display certain advertising offers on the Site or allow service providers, advertisers, ad networks, or other third parties to advertise on the Site. Additionally, we may use third-party software to serve ads on the Site, implement email marketing campaigns, and manage other interactive marketing initiatives. This third-party software may use cookies, web beacons, or similar tracking technology to help manage and optimize your online experience with us.

Most web browsers are set to accept cookies by default. You can usually choose to set your browser to disable or reject cookies. Be aware that disabling or rejecting cookies could affect the availability and functionality of the Site or certain portions of the Site. Please note that we may still use information we’ve collected from cookies prior to you disabling them; however, we will not collect any further information from the disabled cookies.

Data Security

We have implemented measures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Policy for Children

We do not use the Site to solicit information from or market to children under the age of 18. By using the Site, you represent that you are at least 18 years of age. We encourage parents and legal guardians to monitor their children’s internet usage and to instruct their children never to provide personal information through the Site or any other website without parental consent. If you believe a child has provided personal information to us via the Site, please contact us and we will use reasonable efforts to locate and delete the information.

Promotional Messaging

By signing up to our promotional lists, you are giving your express permission to SkinGevity and its agents or vendors the right to contact you with targeted advertising materials by email, text message (SMS), telephone or cellphone, including the use of automated, predictive, programmable, or similar automatic dialers or dialing software, or any other means of communication we may utilize to provide promotional offers. Your consent is not a condition of purchase. To the extent applicable, you expressly acknowledge that you are solely responsible for all charges billed by your mobile service provider.

If you no longer wish to receive promotional communications by email, please follow the unsubscribe link located at the end of an email message. If you no longer wish to receive promotional messages by text, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from SkinGevity. We may share your data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

Do Not Track Signals

Do Not Track (“DNT”) is a privacy preference that users can set to have their Internet browser automatically send a signal to our Site to request we not track browsing activity across different sites. There is, however, currently no universal standard for sending and receiving DNT signals. As such, we cannot promise that we respond to all DNT signals but do recognize and respond when required by applicable privacy laws, such as when HTTP header fields or Java objects are used.

We control and operate the Site and our services from within the United States of America (the “U.S.”). Your information may be transferred to, and processed in, the U.S. or any other country in which our we or our vendors maintain facilities.
